1. Acceptance of Terms

By using ProMatch Photo, you agree to these terms of service. If you do not agree with these terms, you may not use the application.

ProMatch Photo behoudt zich het recht voor om deze voorwaarden op elk moment te wijzigen zonder voorafgaande kennisgeving. Het is uw verantwoordelijkheid om deze voorwaarden regelmatig te controleren.

2. Disclaimer and Limitation of Liability

2.1 "AS IS" Delivery

ProMatch Photo is provided "AS IS" and "AS AVAILABLE" without any warranty of any kind, express or implied. We do not guarantee that the software will be error-free, secure, or available without interruption.

2.2 No Liability for Data Loss

ProMatch Photo is NOT responsible or liable for:

• Loss, corruption or deletion of photos, projects or other data
• Technical failures, bugs or software errors
• Data loss due to browser issues, device failures or other technical causes
• Incompatibility with certain devices or browsers
• Service outages or temporary unavailability of the application

2.3 User Responsibility

You are solely responsible for:

• Making regular backups of your data via the backup functionality
• Storing your backups safely in external locations
• Checking that your photos are correctly stored before deleting originals
• Testing the application on your specific device before using it for critical projects
• Any damage or loss resulting from the use of the application

2.4 Limitation of Damages

In no event shall ProMatch Photo, its owners, developers or employees be liable for any direct, indirect, incidental, special or consequential damages, including but not limited to loss of profits, data or goodwill, arising from the use of or inability to use the application.

The total liability of ProMatch Photo for all claims arising from the use of the application shall in no case exceed €0 (zero euro).

3. Use of the Application

3.1 Permitted Use

You may use ProMatch Photo for professional and personal purposes, as long as you comply with these terms and all applicable laws and regulations.

3.2 Prohibited Use

You may NOT use the application for:

• Illegal activities or purposes
• Distributing viruses, malware or other harmful code
• Infringing the intellectual property rights of third parties
• Disrupting the operation of the application or servers
• Circumventing security measures
• Collecting data from other users without consent

4. Account and Security

4.1 Account Creation

To use certain features, you may need to create an account. You are responsible for:

• Providing accurate and up-to-date information
• Keeping your password and account details confidential
• All activities that occur under your account
• Immediately reporting any unauthorized use of your account

4.2 Account Suspension

ProMatch Photo behoudt zich het recht voor om accounts op te schorten of te verwijderen die deze voorwaarden schenden, zonder voorafgaande kennisgeving of compensatie.

5. Intellectual Property

5.1 Ownership of the Application

Alle rechten, titels en belangen in en op ProMatch Photo, inclusief alle intellectuele eigendomsrechten, blijven eigendom van ProMatch Photo en haar licentiegevers.

5.2 Your Content

You retain all rights to the photos, projects and other content you upload to ProMatch Photo. By using the application you do not grant ProMatch Photo any rights to your content, other than the technical rights necessary to operate the application.

6. Data Storage and Backup

6.1 Local Storage

ProMatch Photo stores most data locally on your device using IndexedDB. This data is not automatically synchronized to the cloud or to other devices.

6.2 Backup Responsibility

IMPORTANT: It is YOUR responsibility to make regular backups of your data via the backup function in the application. ProMatch Photo is NOT responsible for data loss resulting from not making backups.

6.3 No Guarantee of Data Integrity

Hoewel we ons best doen om data-integriteit te waarborgen, garanderen we niet dat uw data altijd beschikbaar, correct, of volledig zal zijn. Browser-updates, apparaatstoringen, of andere technische problemen kunnen leiden tot dataverlies.

7. Quit Claims and Model Releases

ProMatch Photo offers functionality for digitally signing quit claims and model releases. You acknowledge that:

• You are solely responsible for the legal validity of these documents in your jurisdiction
• ProMatch Photo does not provide legal advice regarding model releases or copyrights
• You must verify yourself whether digital signatures are legally binding in your situation
• ProMatch Photo is not liable for disputes arising from quit claims
• It is your responsibility to keep adequate backups of signed documents

8. Changes to the Service

ProMatch Photo behoudt zich het recht voor om:

• De applicatie op elk moment te wijzigen, op te schorten, of te beëindigen, met of zonder kennisgeving
• Functies toe te voegen of te verwijderen
• Prijzen en voorwaarden te wijzigen
• Toegang tot de applicatie te beperken of te weigeren

Wij zijn niet aansprakelijk voor enige schade die voortvloeit uit dergelijke wijzigingen.

9. Governing Law

These terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or relating to these terms shall be submitted exclusively to the competent courts in the Netherlands.

10. Miscellaneous

10.1 Entire Agreement

Deze voorwaarden vormen de volledige overeenkomst tussen u en ProMatch Photo met betrekking tot het gebruik van de applicatie.

10.2 Scheidbaarheid

Als enige bepaling van deze voorwaarden ongeldig of niet-afdwingbaar wordt verklaard, blijven de overige bepalingen volledig van kracht.

10.3 Geen Verzaking

Het niet afdwingen van enige bepaling in deze voorwaarden betekent niet dat we afstand doen van het recht om deze op een later moment af te dwingen.
